In March 2012, the Ministry of Information, Communications and the Arts (MICA) released a public consultation on “Proposed Personal Data Protection Bill”, the third consultation following 2 previous exercised to seek feedback on the proposed consumer data protection regime. Similarly, in June 2012, the Monetary Authority of Singapore (MAS) put up a consultation paper to update its guidelines to address concerns regarding IT Outsourcing, data protection, as well as information systems reliability.
How will these new regulatory changes, if implemented, affect investment managers in Singapore, as well as the fund management industry as a whole? How will these changes reconcile with other regulations, such as the Banking Secrecy Act, and transfers of consumer data within related business entities, or to third-party businesses for the purpose of IT outsourcing?
